An article written by Adam L. Rosen and Christopher J. Rubino, entitled The Rights and Treatment of Non-Debtor Contract Counterparties in Bankruptcy, was recently published in the February volume of the Law Journal Newsletters’ Equipment Leasing Newsletter and will be published in a forthcoming volume of the Bankruptcy Strategist.  Their article analyzes the rights and remedies of counterparties to executory contracts in bankruptcy and the steps those counterparties can take to protect their rights when debtor in bankruptcy breaches the contract.

Brian Powers, a law clerk with the firm awaiting admission to the New York State Bar, recently had his article published in the Winter 2013 issue of the American Bankruptcy Institute Law Review. The American Bankruptcy Institute Law Review is one of the premier scholarly publications in the United States on the topic of bankruptcy and insolvency. Mr. Powers's article, entitled “Can You Trust Your Trustee? Expanding Homestead Exemptions to Include Rent-Controlled Leasehold Interests,” 20 Am. Bankr. Inst. L. Rev. 741 (2013), proposes an amendment to state and Federal exemptions to include rent-controlled leases. The article details the lack of protection in bankruptcy proceedings afforded to low-income individuals living in rent-controlled apartments, and proposes a solution that is consistent with the purpose of exemption laws.

Kenneth P. The Tulane Alumni Club of New York has appointed Jessi Kleinman as the Chairperson of its Young Alumni Committee.  Ms. Kleinman, a law clerk with the firm awaiting admission to the New York Bar, will plan events geared toward recent graduates of her alma mater, Tulane University.  She will also work with new alumni to integrate them into the broader Tulane alumni network.

Considered by many to be the most difficult bar examination in the country, law clerks Jessi L. Kleinman, Cooper J Macco, Brian Powers and Christopher J. On November 4, 2012, SilvermanAcampora associate Sheryl P. Giugliano will be running in the 2012 ING New York City Marathon for the National MS Society, Long Island chapter. On Saturday, November 17, 2012, SilvermanAcampora’s Christopher Rubino will be competing in the World’s Toughest Mudder, a 24 hour race spanning over 56 miles and including dozens of obstacles designed by members of the British Special Forces. Mr. Rubino gained entry into the World’s Toughest Mudder race by placing in the top five percent of all Tough Mudder competitors in the Tough Mudder event in Pennsylvania on May 13, 2012.

Christopher Rubino, a law clerk with the firm who will be joining the firm as an attorney in September, had his article published in the Spring 2012 issue of the American Bankruptcy Institute Law Review. The American Bankruptcy Institute Law Review is one of the premier scholarly publications in the United States on the topic of bankruptcy and insolvency. Mr. Rubino’s article, entitled “The Ever-Expanding Scope of Securities and Commodities Safe Harbors in Bankruptcy,” 20 Am. Bankr. L. Rev. 423 (2012), explores the recent judicial expansion of safe harbors under the bankruptcy code for securities and commodities. The article focuses specifically on protections afforded to investors in Ponzi schemes as well as protections given to commodities forward contracts under section 546(e) of the Bankruptcy Code.

SilvermanAcampora partner Robert J. Ansell recently spoke at the career day of Valley Stream Central High School. Mr. Ansell shared his experiences and offered advice to the teens, hoping to assist them in setting their professional goals. “As everyone knows,” Mr. Ansell said, “the job market is very difficult not only for those with work experience, but especially for high school graduates. Spending time with those soon to be graduates on career day gives them some glimpse into the working world and hopefully helps them in making decisions about their careers.”

SilvermanAcampora Trusts and Estates attorney, Kimberly C. Preston was named the January/February 2012 Molloy College Alumni of the Month. SilvermanAcampora has been retained to represent Lighthouse Financial Group, LLC and its subsidiary, Lighthouse Global Partners LLC in chapter 11 proceedings in the United States Bankruptcy Court for the Southern District of New York. After months of negotiations, the historic Woodcrest Club, represented by SilvermanAcampora partners Kenneth Silverman and Gerard Luckman, sold at auction for $19 million. The final sale of the property closed in June 2010. SilvermanAcampora is currently working with the debtor to make distributions to creditors and equity holders.

Ronald J. Friedman has been named as a panelist for an upcoming webinar entitled “Retention of Estate Professionals in Successor Cases,” hosted by the Turnaround Management Association. On February 9, 2010, SilvermanAcampora Partner Gerard Luckman shared his considerable knowledge and expertise with IMA members and guests at the Institute’s monthly dinner meeting. The 50 year old Woodcrest Club has called upon SilvermanAcampora to handle its multimillion dollar restructuring in its chapter 11 bankruptcy case pending in the Eastern District of New York.  The Woodcrest Club, which sits on 107 acres in Muttontown, New York, is exploring various possibilities with SilvermanAcampora, including a sale of its assets.

Southern District of New York Bankruptcy Court Judge Burton Lifland approved a $26.3 million reorganization plan for retailer Crabtree & Evelyn. The plan, financed by parent company and SilvermanAcampora client KLK, will allow Crabtree & Evelyn to reorganize on its own and exit bankruptcy protection by the end of the month; a feat that has become exceedingly rare in today’s difficult economic climate. SilvermanAcampora is pleased to have crafted a plan that both benefits KLK and allows Crabtree & Evelyn to emerge from bankruptcy protection as a stronger, more efficient retailer.

Anthony C. Acampora has been nominated to serve on the board of directors of the Long Island Chapter of the National Multiple Sclerosis Society.

Ronald J. Friedman successfully represented the chapter 11 Trustee for Ridgemour Meyer Properties, LLC in confirming a chapter 11 plan relating to a substantial real estate project in White Plains, New York. His continued operation of income producing, prime real property fostered circumstances that allowed equity holders to confirm a plan of reorganization, resulting in paying unsecured creditors 100% plus interest, increasing the monthy rent roll, and leadning to a settlement of partnership developer's claims involving multi-year litigations for the sum of $5.7 million.

SilvermanAcampora LLP, as debtor’s counsel to Mrs. John L. Strong in its pending chapter 11 bankruptcy case, assisted the company in closing on a sale of substantially all of its assets, including its intellectual property, for $975,000 after conducting an auction on September 23, 2009 in the S.D.N.Y. Bankruptcy Court. The opening initial overbid was $525,000. The sale closed on October 22, 2009, with the proceeds anticipated to provide a significant return to general unsecured creditors. Silverman Acampora LLP continues to assist the Debtor in winding down in chapter 11.

Ronald J. Friedman, a Partner at SilvermanAcampora LLP, has been appointed as post-confirmation Trustee for Mark IV Industried, Inc in its chapte 11 cases pending in the United States Bankruptcy Court of the  Southern District of New York. Mark IV Industries, Inc is a leading manufacturer of engineered systems and components for transportation infrastructure, vehicles, and equiptment with world wide operations, 4,200 employees, and $1.4 billion in sales.

In September 2009, SilvermanAcampora LLP successfully negotiated a settlement for the unsecured creditors of AGT Crunch Fitness. The "Crunch" cases involve 22 separate debtors with over &80 million in annual sales and 1716 employees operating 37 fitness training clubs throughout the United States.

Hon. Harold Baer, United States District Court for the Southern District of New York, has appointed Ronald J. Friedman, Esq., receiver in Arista Records LLC, et al. v. Usenet.com, et al., the Recording Industry Association of America's multi-million dollar copyright infringement action against a popular "peer to peer"  file sharing network.  Having granted summary judgement against Usenet.com's principal, Gerald Reynolds, Judge Baer appointed Mr. Friedman to marshal and liquidate all of Reynolds' property for the benefit og the Recording Indusrty plaintiffs.

The shared assets trustee in the bankruptcy case of jewelry wholesaler M. Fabrikant & Sons. Inc. has filed dozens of adversary complaints in recent weeks.

A filing today by Kenneth Silverman, trustee in Interep’s Chapter 7 bankruptcy, asks the bankruptcy court to allow Interep to accept a cash payment of $3.64 million from Katz Media in exchange for the right to negotiate with Interep’s clients. The agreement must be approved by the court before it can go into effect -- it’s now on the docket for Tuesday, November 25 – and does not represent the purchase of Interep by Katz...

Randy J. Schaefer has been appointed the temporary receiver in two cases currently pending in Suffolk County District Court. As temporary receiver, Ms. Schaefer is tasked with collecting rents and bringing the real property involved into compliance with the Huntington Town Code.
