An article written by Adam L. Rosen and Christopher J. Rubino, entitled The Rights and Treatment of Non-Debtor Contract Counterparties in Bankruptcy, was recently published in the February volume of the Law Journal Newsletters’ Equipment Leasing Newsletter and will be published in a forthcoming volume of the Bankruptcy Strategist. Their article analyzes the rights and remedies of counterparties to executory contracts in bankruptcy and the steps those counterparties can take to protect their rights when debtor in bankruptcy breaches the contract.
American Bankruptcy Institute Law Review Publishes Article by Brian Powers

Brian Powers, a law clerk with the firm awaiting admission to the New York State Bar, recently had his article published in the Winter 2013 issue of the American Bankruptcy Institute Law Review. The American Bankruptcy Institute Law Review is one of the premier scholarly publications in the United States on the topic of bankruptcy and insolvency. Mr. Powers's article, entitled “Can You Trust Your Trustee? Expanding Homestead Exemptions to Include Rent-Controlled Leasehold Interests,” 20 Am. Bankr. Inst. L. Rev. 741 (2013), proposes an amendment to state and Federal exemptions to include rent-controlled leases. The article details the lack of protection in bankruptcy proceedings afforded to low-income individuals living in rent-controlled apartments, and proposes a solution that is consistent with the purpose of exemption laws.

On Saturday, November 17, 2012, SilvermanAcampora’s Christopher Rubino will be competing in the World’s Toughest Mudder, a 24 hour race spanning over 56 miles and including dozens of obstacles designed by members of the British Special Forces. The American Bankruptcy Institute Law Review is one of the premier scholarly publications in the United States on the topic of bankruptcy and insolvency. Mr. Rubino’s article, entitled “The Ever-Expanding Scope of Securities and Commodities Safe Harbors in Bankruptcy,” 20 Am. Bankr. L. Rev. 423 (2012), explores the recent judicial expansion of safe harbors under the bankruptcy code for securities and commodities. The article focuses specifically on protections afforded to investors in Ponzi schemes as well as protections given to commodities forward contracts under section 546(e) of the Bankruptcy Code.

Woodcrest Club Sold

After months of negotiations, the historic Woodcrest Club, represented by SilvermanAcampora partners Kenneth Silverman and Gerard Luckman, sold at auction for $19 million.
