SilvermanAcampora’s Litigation Group represents individual and corporate clients in complex and sophisticated commercial and bankruptcy litigation in state and federal courts throughout the United States. The attorneys in our Litigation Group have significant trial and appellate experience and a deep, substantive knowledge of the legal and business issues that face our clients. Because our attorneys invest the time and energy necessary to attain a comprehensive understanding of our clients’ businesses, their advice and representation is tailored to fulfilling the individual needs and expectations that enable our clients to prosper.
The Group has achieved success for our clients in matters involving asset based, secured and unsecured loan transactions, contract disputes, construction claims, corporate and partnership disputes and dissolutions, employment disputes, financial instruments, fraud, lender liability, lease and real estate disputes, leveraged buyouts, mortgage foreclosures and sales, commercial transactions, and accountants’ liability and malpractice. It often achieves expedited recoveries or favorable settlements by obtaining emergency relief, such as temporary restraining orders and injunctions as well as orders of attachment or replevin, when available, at the inception of litigation.
Our attorneys also have extensive experience representing a diverse group of parties in bankruptcy litigation, including debtors, individual creditors, creditors’ committees, and trustees in matters ranging from the simplest claim dispute to complex fraudulent conveyance issues arising out of multimillion dollar leveraged buyouts. In coordination with the Bankruptcy and Creditors’ Rights Group, attorneys from the Litigation Group handle bankruptcy disputes such as preferences, fraudulent transfers, applications for relief from the automatic stay, requests to utilize cash collateral, reclamation proceedings, and motions to assume or reject executory contracts or leases as well as more complex and cutting edge issues. Our litigators also assist the Corporate and Real Estate Group in matters involving real estate litigation and regularly advise the Corporate Restructuring Group regarding the litigation options available to our clients.
The Group’s attorneys understand that litigation does not always provide the best solution to a client’s problem and often enable clients to realize outstanding results through the use of alternate dispute resolution mechanisms, including effective settlement negotiation, mediation, and arbitration. Several of our attorneys serve as court-appointed or privately selected mediators and arbitrators. They regularly lecture and chair continuing legal education seminars and programs for the New York State Bar Association and other organizations.
